Terms of Use: Delivery, Moving and Purchasing

- Introduction
1.1 Please read these Terms of Use carefully. These Terms of Use and the iDelivos Policies (as defined below ) constitute a legally binding agreement (“Agreement”) between you and iDelivos (as defined below). By accessing and using the Service (as defined below), you agree that you have read, understood and accepted the terms described in this Terms of Use.If you do not agree with the Terms of Use, please do not use the Platform (as defined below) or the Service.
1.2 iDelivos reserves the right to amend the terms in this Agreement at any time. Such amendments shall be effective once they are posted on https://www.idelivos.com or the Application. It is your responsibility to review the Terms of Use and iDelivos Policies regularly and you are strongly recommended to do so. Your continued use of the Service after any such amendments, whether or not reviewed by you, shall constitute your agreement to be bound by such amendments.
1.3 A1 SUPERHEROES PTE LTD is the company which provides the iDelivos Platform for users to obtain delivery, moving and/or purchasing services. The services may be supplied by iDelivos and/or provided by a third party provider. Where the service is provided by a third party, iDelivos’s role is merely to link the user with such third party provider. iDelivos is not responsible for the acts and/or omissions of any third party provider, and any liability in relation to such services shall be borne by the third party provider. Third party providers shall not represent to be an agent, employee or staff of iDelivos and the Solutions provided by the third party providers shall not be deemed to be provided by iDelivos
- Definitions
2.1 “iDelivos” refers to A1 SUPERHEROES PTE LTD, a company incorporated in Singapore, operating under the name “iDelivos” in Singapore.
2.2 “You” refers to Partner and/ or User as may be applicable.
2.3 “Application” refers to the iDelivos Driver smartphone application made available for download by iDelivos to Partners.
2.4 “Partner” refers to the independent third party who have agreed to accept bookings through iDelivos Platform and provide the relevant Solutions to Users through the Service, including delivery-partners, moving-partners and purchasing-partners. Partners are not iDelivos.
2.5 “Platform” refers to the iDelivos Driver App, portal and website which iDelivos owns, operates or otherwise makes available to Users and/or Partners for the purposes of or in connection with the Services and/or Solutions.
2.6 “Service” refers to the linking of Users to Partners or other Users to facilitate the Solutions;
2.7 “Shipment” refers to all packages, parcels, delivery items or any part of the articles therein or contents thereof that travel under one delivery request, proposed journey, consignment note and/or invoice. The service to be provided through iDelivos Platform is limited to the pickup, transportation and delivery of the shipment. Customer acknowledges that shipments may be consolidated with those of other requestor. Every shipment is transported on a limited liability basis as provided herein.
2.8 “Solutions” refer to the delivery and/or moving and/or purchasing services which are made available to Users through the Platform.
2.9 “Terms of Use” refers to the terms and conditions that apply to the services as set out on “www.idelivos.com” and may be amended from time to time without prior notice.
2.10 “User” or “Customer” refers to any person/party who accesses or uses the Platform to search for and obtain the Solutions.
3. Duration of Service for orders according to vehicle type
3.1. Generally there are 3 types of Service Durations;

3.4 Next-Day Delivery

- Charges
4.1. The total charges for an order consist of the Service Price and Bonus stated in the booking form by the User plus any additional charges for services that was not stated in the booking form.
4.2. iDelivos provides suggested Service Price and Suggested Bonus amount in the booking form. The User decides and enters the Service Price offer and Bonus offer. By confirming the booking request, User accept to pay the Service Price and Bonus if the booking is accepted and completed by a Partner, while agreeing that additional charges may be imposed according to Clauses 4.9, 4.10 and 4.11.
4.3 Service Price includes the transportation of the Shipment within the specific dimension and quantity to the recipient plus any selected options listed in Clause 4.4.
4.4 The User shall state clearly what is required in the Booking form and the options for selections in the booking form includes;
(a) Manpower for Moving Services Using Van/ Lorry ( Choose one below )
i. Moving Services Not Required

iii. Driver + 1 Assistant
iv. Driver + 2 Assistants
(b) Purchasing Service ( Choose one below )
i. Purchasing Service Not Required
ii. Purchase of Food
iii. Purchase of Non-Food
(c) Simple Pickup ( Select if applicable )
(d) Simple Delivery ( Select if applicable )
(e) Special Location with Security Clearance ( Select if applicable )
4.5 There are no separate additional charges for ERP, parking, CBD surcharge or special holiday surcharge. Users are recommended to treat Delivery Partners fairly and offer Bonus for Delivery Partners to reward and motivate them for their effort and time.
4.6 Special Location with Security Clearance include Jurong Island, Jurong Port, Airport Cargo Rd, Alps Ave, Airline Rd, Airport Zone, Checkpoints, Military Camps, PSA Ports, Shipyards, SATS, Aerospace areas, Construction sites, supply bases, any other special locations that requires Partner to go through security clearance.
4.7 The latest pricing, dimension and guidelines are listed on https://idelivos.com/prices/
4.8 The guidelines may be amended and updated at iDelivos sole discretion from time to time.
4.9 When Simple Pickup is selected by User in the booking form, User agrees that he has checked and confirmed that No parking/ waiting beyond 1-minute at Pickup point required. Prior to submitting the booking form, User must check and ensure that the Pickup location is safe for Partner’s vehicle to stop and Partner will not need to violate any traffic rules/ MCST rules by stopping at the Pickup location. Customer must provide manpower to load items into Partner’s vehicle immediately upon Partner’s arrival. Additional Charge of SGD5 apply if this option is selected & the conditions stated above are not met. In such scenario, the Partner will need to find suitable parking location before proceeding with Pickup.
For Simple Pickup, the maximum grace period is 1-minute waiting time. After 1-minute grace period, every 10 minutes or part thereof of waiting time is charged at prices listed below;

4.10 When Simple Delivery is selected by User in the booking form, User agrees that he has checked and confirmed that No parking/ waiting beyond 1-minute at Delivery point required. Prior to submitting the booking form, User must check and ensure that the Delivery location is safe for Partner’s vehicle to stop and Partner will not need to violate any traffic rules/ MCST rules by stopping at the Delivery location. Customer must provide manpower to unload items out of Partner’s vehicle immediately upon Partner’s arrival. Additional Charge of SGD5 apply if this option is selected & the conditions stated above are not met. In such scenario, the Partner will need to find suitable parking location before proceeding with Delivery.
4.11 Additional Charges
4.11.1 Waiting time charges: For Pickup except Simple Pickup, there is a grace period of 10 minutes waiting time by Delivery Partner, counted from the Partner arrival time or scheduled pickup time, whichever is later. Subsequently, waiting time charge listed below applies for every 10 minutes and/or part thereof of waiting time.

4.11.2 Overtime charges
Express & Moving Services by Van and lorry are capped at 2 hours of service time upon arrival of Partner or scheduled time of order, whichever is later. If service takes longer than 2 hours, a SGD5 charge applies for every 10 minutes and/or part thereof of overtime charge per hired driver/ assistant. Maximum overtime charges for van and lorry services are SGD200.
4.11.3 Oversized item charge: If the requirement or parcel exceed maximum weight or size specified under https://idelivos.com/prices/, User shall choose one of the below options;
4.11.3.1 User cancel the order with half of the Service Price borne by the User if the Partner already showed up to perform the job. User make a new booking for the correct type of vehicle, services and required.
4.11.3.2 Ad-hoc additional assistant from Partner if available and User agreeable to use. Additional assistant charge: Applies when a single item is 25kg and above. Applicable to jobs that involve van or lorry only.

4.11.4 Change of address charge: User will be charged the price of an additional trip from the original address to the new address provided. The price will be calculated based on the distance of the additional trip and the average per km rate of the initial Service Price plus an additional stop charge below.
Price of additional trip = ( Average per km rate of initial Service Price ) x ( Travelling distance between original address and the new address provided ) + Additional Stop Charge described below.
Google Maps will be used to determine the Travelling distance between the original address and the new address.
Additional Stop Charge depends on the vehicle requested to perform the job;

4.11.5 Moving Service charges (For jobs involving van and lorry only):
4.11.5.1. User shall make an assessment on the Manpower needed from Idelivos Partner before completing the booking form.
Should any single item exceed the weight of 25kg, User shall agree that at least one other person is required to assist in carrying and/or moving the item. That additional person could be provided by the User or User shall request for assistant(s) from iDelivos Partner when placing the booking.
If there are flights of stairs that the movers need to traverse, User shall consider providing help to the driver or request for additional assistant(s) in the booking form.
4.11.5.2 In the booking form, User shall clearly indicate the Manpower for Moving Services Using Van/ Lorry ( Choose one below )
i. Moving Services Not Required
ii. Driver only
iii. Driver + 1 Assistant
iv. Driver + 2 Assistants
4.11.5.3 If needed, the driver’s help or the number of additional assistant(s) required shall be clearly indicated in the booking form by User.
For Moving Services, van and lorry drivers are not obligated and may not assist in moving items door-to-door unless User requested “Manpower for Moving Services” in the booking form.
4.11.5.4 If driver’s help is not stated in the booking form and driver’s help is required after booking is confirmed, price for driver’s help is SGD30.00 for up to two hours of service, counted from the pickup time requested by User or driver’s arrival to the pickup point, whichever is later.
4.11.5.5 Additional assistant(s) from iDelivos Partner may not be available if the request for additional assistant(s) is made only after booking is confirmed.
4.11.5.6 If moving by van and additional assistant is required after booking is confirmed, price per additional assistant is SGD30.00 for up to two hours of service, counted from the pickup time requested by User or Partner’s arrival to the pickup point, whichever is later.
4.11.5.7 If moving by lorry and additional assistant is required after booking is confirmed, price per additional assistant is SGD40.00 for up to two hours of service, counted from the pickup time requested by User or Partner’s arrival to the pickup point, whichever is later.
4.11.6 Miscellaneous charges with prices defined by iDelivos.
These are charges which the Partners are not allowed to provide their own quote but must follow iDelivos pricing guidelines below.
4.11.6.1 Moving items without lift access
Moving items up or down each flight of stairs is charged SGD10.00 per driver or assistant.
User shall take note that moving up or down one floor level could involve multiple flight of stairs.
Calculation example: Moving service with 2 persons (driver and one assistant) carrying items up or down 1 flight of stairs = 2 x 1 x SGD10.00 = SGD20.00
4.11.6.2 Wrapping service for each piece of furniture/ TV/ electrical/ electronics appliance is charged at SGD20.00.
4.11.6.3 For lorries, the charge for Tailgate service is SGD20.00.
4.11.7 Miscellaneous charges with prices open for quotation by Partner to User.
There are charges for additional services that are not listed by iDelivos.
The Partner is allowed to provide own quotation to the User.
These include but are not limited to charges for dismantling, assembly and storage.
Such quotation must be provided by the Partner to the customer before the commencement of the job.
Partner will only carry out such additional services with the User’s agreement.
4.11.7.1 If the User is not agreeable with the quote, User shall contact iDelivos Customer Service at +65 6230 7939 before the commencement of the job. If iDelivos is contacted following the completion and payment of such a job, iDelivos will not be able to assist customer with any compensation.
4.11.7.2 In case of additional charges being requested by the Partner, and if these charges were not part of the original booking requirements, it is the User’s obligation to inform iDelivos Customer Service of these charges prior to paying the Partner.
4.11.8. Cancellation charges:
4.11.8.1 Under normal circumstances, User cancellation of order must be made through the booking form. User must click on the “Cancel” button inside Booking Form> Order History> Task ID.
User shall ensure all relevant Task IDs for Pickup & Delivery are cancelled.
4.11.8.2. For Express orders: 50% of the Service Price is charged when one of the following happens;
(i) User cancels 5 minutes after booking is accepted by the Partner.
(ii) User cancels after the delivery Partner arrives at the pickup location.
4.11.8.3. For Same-Day and Next-Day orders: 50% of the Service Price is charged when one of the following happens;
(i) User cancels 2 hours or less before the Pickup time.
(ii) User cancels after the delivery Partner arrives at the pickup location.
4.11.8.4 User agrees that the User’s failure to inform iDelivos of any User cancellation within 2 hours after the scheduled pickup time using the communication methods described in Clause 4.11.8.1 will render the User liable to pay the full Service Price and Bonus.
4.11.8.5 User remain liable to pay the Service Fee and Bonus in full in the event that the recipient indicated in the booking form is physically unreachable or uncontactable after 5 minutes from the Partner’s arrival time at the delivery location.
4.12 For Purchasing Service, the User shall pay directly the Partner only the purchase value of the item(s) before the Partner carries out the Service. The payment should be transferred by PayNow, PayLah or local bank transfer services using immediate transfer without delay. User must ensure full payment equal to the purchase price of the item(s) is received by the Partner. The full payment shall exclude any bank charges incurred as a result of the transfer. The Partner uses the transferred payment to purchase the item(s) as instructed by the User. Should there be any additional amount overpaid to the Partner, the Partner shall return the balance sum to the User immediately upon delivery of the Service.
For any additional charges not paid by the User using Card payment through the iDelivos Platform, User shall pay the cash sums immediately when due unless otherwise agreed by both parties. If any of the parties does not agree with the charges, iDelivos Customer Service must be contacted prior to payment to the Partner.
4.13 iDelivos do not provide printed receipts/ invoices. A digital receipt will be automatically provided after completion of an order, sent to one e-mail address provided by the User. The default e-mail that will be used is the e-mail address stated as the e-mail address together with the details of the 1st Pickup location in the booking form. If the e-mail address is not stated in the booking form, the digital receipt will be sent to the e-mail address of the User account.
- Payments
5.1 Payment Terms for Partners
5.1.1 iDelivos charges 16% commission from the User Service Price for the Partner’s use of the Service. The commission charge is payable by the Partner immediately upon completion of the Service and are non-refundable.
5.1.2 Partner’s Service Earnings is the amount the Partner receives from the Service Price after deduction of the commission charge.
5.1.3 The full Bonus amount from the User will be paid to the Delivery Partner.
5.1.4 Partner shall ensure full submission of required bank account & identification details to Stripe and/or iDelivos when requested, so as not to cause any delay in payment processing to the Partner.
5.1.5 The typical payout speed under normal circumstances is 7 calendar days. New Partner account might take 7-10 days to receive first payment.
5.1.6 If there are transaction which iDelivos reasonably believe to be suspicious, disputed, fraudulent, or if Partner and/or User breached any of the Terms of Use, iDelivos and the appointed payment processor company reserves the right to suspend the processing of any transaction, until full investigations are completed. In such an event, the Partner should not hold iDelivos liable for any delay in, withholding of, suspension, forfeiture or cancellation of. any payment to the Partner.
5.1.7 Service Earnings plus Bonus for a Multi-Stop delivery is usually shown as one total amount in the iDelivos Driver App on the 1st Delivery location. This amount is the total that the delivery Partner will receive upon completion of the entire Multi-Stop delivery. It should not be regarded as Partner’s revenue for delivery to the 1st delivery location only.
5.2 Payment Terms for Users
5.2.1 All payment from User to iDelivos for all the Services offered shall be made using credit or debit card only.
5.2.2 All User payments to iDelivos are required to be made at the time of booking.
- User’s Obligations
6.1. The User warrants that he is either the Owner or the authorised representative of the Owner of the delivery item(s), and that he is authorised to accept and is accepting these Terms of Use for himself or as a representative acting for and on behalf of the Owner of the delivery item(s).
6.2 User shall not use iDelivos Solutions to send any items below;
Poisonous or toxic substances.
Explosive, flammable, hazardous, radioactive and unsafe materials, substances or items including power banks
Examination certificates, passport and insurance documentations which cannot be reproduced.
Written drafts, original films, tapes and film material which cannot be reproduced.
Any items and/ or substances prohibited by law ( e.g. pornographic magazines, imitation weapons, weapons, illegal drugs )
Live animals and plants
Raw meat, raw seafood, frozen food and/ or dairy products
Cash, credit or debit cards
Passport, Driving Licence and/or other official identification documents
Any item(s) where the total value exceed SGD500
Precious metals, stones & bullion
Counterfeit goods
6.3 iDelivos and/or Partner reserves the right to open and inspect the Shipment without prior notice to User/ Sender based on any reasonable suspicion that the Shipment may contain non-compliant or prohibited items as mentioned in Clause 6.2.
6.4 The User is liable for any loss or damage suffered by any third party as a result of any breach of the terms. iDelivos and/or the Partner bear no responsibility in any legal liability resulting from the transportation of the shipment.
6.5 The User is responsible to give to the Partners sufficient, accurate and executable instructions including recipient’s name, contact details & delivery address. Address changes carried out through direct calls with Partner shall not be accepted as proof of address change. Any extra costs arising from the difference between the provided information and actual situation shall be borne by the User. Any amendment or change in order pricing is to be abided by, approved and updated with iDelivos. Any dispute management, refunds, cancellation or amendment to processed payments must be informed to and directly managed by iDelivos. iDelivos shall not be liable in the event of late delivery or non-delivery of delivery items caused by errors in delivery details provided by User in the booking form.
6.6 User shall ensure that the shipment is adequately and properly packaged so as to protect against damage to the shipment during the course of delivery, and no part of the shipment may be removed without the case, wrapper or container being torn or broken, a seal being broken or two adhesive surfaces being forced part.
6.6.1. In the case of a shipment is of a fragile nature, that shipment shall be packaged in a case or container of sufficient durability and strength and shall be encased in or surrounded by sufficient and suitable protective material inside that case or container such that the shipment is guarded against damage that may result from any force, pressure or blows to which delivery items are ordinarily subject during the course of delivery and that such shipment shall bear the word “FRAGILE” prominently displayed in capital letters on the face of the case or container and above the address of the named addressee; and
6.6.2. In the case of a shipment which is susceptible to damage by bending, that the shipment shall be packed in a case or container of sufficient durability and strength to prevent the shipment from being bent or otherwise damaged during the course of delivery and such case or container shall bear the words “DO NOT BEND” prominently displayed in capital letters on the face of the case or container and above the address of the named addressee.
6.7 User agrees that delivery of second-hand items will not be eligible for compensation.
6.8 iDelivos shall not be responsible to provide a protective service for the transportation of perishable commodities or commodities requiring protection from heat or cold. Such commodities will be accepted for transportation solely at the customer’s risk for any damages arising from the transportation.
6.9 The User shall provide in respect of each shipment all necessary information, including without limitation:
6.9.1. The User’s name, address (including the postal code) and telephone number;
6.9.2. The recipient’s name, delivery address (including the postal code) and telephone number;
6.9.3. Special precautions to be taken in respect of the shipment e.g. “FRAGILE”, “PERISHABLE”, “DO NOT BEND” etc.;
6.10 iDelivos is not provided as an anonymous service. The User agree that in the course of delivery of the Shipment, the User and/or sender details may be disclosed to the recipient. iDelivos shall not be liable for any indirect or direct losses suffered by the User in connection with User/ sender expectations of anonymity through the use of the Solution.
6.11 If the intended recipient is absent from the designated delivery location specified by User and no other person is present to receive the Shipment, the Partner will attempt to contact the User or intended recipient to request further instructions on how to proceed.
6.12.1 If the User and recipient cannot be contacted for 5 minutes upon Partner’s arrival at the delivery location, the Partner reserves the right to decide on one of the following;
(a) Leave the Shipment unattended on or in front of the premise of the delivery location and the Shipment shall be deemed to have been delivered. After delivery of the Shipment, User shall be liable for all loss, damage, soiling or degradation of the items in the Shipment whether caused directly or indirectly by User or any other person acting on your behalf or otherwise.
(b) Check the items in the Shipment & alert the Police if there is suspicion that the items and/or substances are prohibited by law.
(c) If the items are found to be perishable item such as food, User agrees that the Partner reserves the right to dispose the items unless there are specific instructions in the booking form that request the Partner to leave the Shipment unattended on or in front of the premise of the delivery location.
6.12.2 You agree to pay the Service Price and Bonus in full where the recipient whom you indicated in the booking form is unreachable physically or uncontactable after 5 minutes from the time that the Partner arrives at the delivery location.
6.13 We reserve the right to suspend, restrict or terminate your access to iDelivos and the services at any time without advance notice or liability if we have reasonable grounds to believe you have breached any of these terms or in our opinion you misused iDelivos or the services. This shall not limit our right to take any other action against you that we consider appropriate to defend our rights or those of any other person.
6.14 The User accepts that the Partner is not obligated to allow passengers on board Partner’s vehicle. The decision to carry passengers is a matter that is up to the discretion of the Partner. Partner & User must ensure that they adhere to local laws & regulations pertaining to this matter and that there is sufficient insurance coverage.
6.15 Purchasing Services
6.15.1 Purchases made through the Purchasing Services can be either goods or services.
6.15.2 Customer must ensure the correct type of delivery vehicle is selected according to the size, weight and suitability type of purchase items.
6.15.3 User need to pre-pay to Partner in advance before items are purchased. As you need to first transfer payment for the items to the Partner before the Partner purchases the items for you, you should be aware that there are risks of full losses that will be borne by you in the event that the service is not well executed by the Partner.
6.15.4 User accepts that iDelivos will not be liable for any losses arising from the loss of or damage to the goods or services.
6.15.5 User accepts that Partner could take up to 2 hours to complete the Service.

6.16 Partner reserves the right to cancel the order if the User’s order do not adhere to Clauses 6.15 above.
6.17 User shall not contact Partner for purposes other than in connection with the Service.
6.18 Users are encouraged to communicate any special requirements not catered within the iDelivos platform, using the Contact Us Form.
- Partner Obligations & Liabilities
7.1. Partners shall take all reasonable precaution to prevent unauthorised persons from having access to the shipment and shall also take all reasonable precaution against loss of or damage to the shipment.
7.2. Partners shall make reasonable effort to deliver the shipment according to the respective delivery schedules, which are estimates only and not guaranteed.
7.3. Partners shall not be liable for any loss or damage arising from or in connection with;
7.3.1. The delivery of shipment set out in Clauses 4.11.
7.3.2. User’s failure to specify any precautions to be taken in respect of a shipment, as required under Clauses 6.6;
7.3.3. Partner’s failure to perform any of his/ her obligations hereunder as a consequence of circumstances outside his/her control;
7.3.4. Any acts or omissions of any party other than the Partner.
7.4. Partners are not obligated to allow customers to ride with them. This matter is up to the discretion of the Partner. Partner & User must ensure that they adhere to local laws & regulations pertaining to this matter and that there is sufficient insurance coverage.
7.4.1. Partners are strictly not allowed to extend quotation out of iDelivos’s delivery app pricing for ferrying of users.
7.5. By signing up as a Partner for iDelivos platform, you authorize A1 SUPERHEROES PTE LTD to quote the relevant service charges on your behalf as per the pricing rates stated on the Platform.
7.6. Acting as an agent between you and the users, A1 SUPERHEROES PTE LTD reserves the rights to claw back all payments made to you if the User defaults any payments to A1 SUPERHEROES PTE LTD.
7.7. Cancellation of order by Partner
The Users put their trust and rely on Partners to deliver the Solutions. Partners shall agree that cancellation of orders causes inconvenience to the Users and negatively affects the reputation of iDelivos.
7.7.1 Partners agree that any cancellation of order requested by the Partner should be based on acceptable cancellation reasons as shown in the iDelivos Driver App.
7.7.2 iDelivos reserves the right to update or change the list of acceptable cancellation reasons from time to time.
7.7.3. Partner reserves the right to cancel the order if the item(s) are still not ready for pickup after 30 minutes counted from the scheduled pickup time.
7.7.3.1 In this scenario, Partners will not be able to claim for any waiting time charges and/or cancellation fees from Users or iDelivos. Partners will not be liable for any disruption to Users’ deliveries.
7.7.4 Partner agrees that the Partner’s access to the Platform can be temporarily suspended or restricted by iDelivos if the Partner choose to cancel or ignore an accepted order without an acceptable cancellation reason.
7.8 If the Partner is on suspension, all future orders must be unassigned.
7.9 Partners should not engage with our customers outside of iDelivos’s platform directly/indirectly within a period of 6 months after the order is being completed.
7.10 Should customer have special requirements not catered within the iDelivos platform, Partners are obligated to direct customer to iDelivos using the Contact Form for assistance.
- iDelivos’s Liability
8.1. Customer agrees that iDelivos’s liability in respect of the shipment is strictly limited to direct loss only. All other types of loss or damage are excluded (including but not limited to loss of profits, income, interest, future business, or loss of revenue resulting from loss of use), whether such loss or damage is special or indirect, and even if the risk of such loss or damage was brought to iDelivos’s attention before or after acceptance of the delivery request. customer shall insure at its own costs against any risks in respect of the shipment.
8.2 iDelivos’s total liability in respect of any shipment shall be limited to its actual cash value or the cost of the delivery order (whichever is the lower). One shipment is defined as a delivery order with one unique order code and may include one or more stops. Customer shall not raise more than one claim for each shipment and settlement of such claim shall be full and final settlement for all loss or damage in connection with such shipment. If customer considers these limits as insufficient to protect itself or the shipment, then it must make its own insurance arrangements, failing which customer shall assume all risks of loss or damage in respect of the shipment. iDelivos shall not be under any liability to offer customers’ cargo insurance or to buy any insurance in respect of the shipment. Customer who needs cargo insurance or all risk insurance should purchase those insurances from third parties.
- Exception to iDelivos’s Liability
9.1. iDelivos shall not be liable for loss or damage arising from or in connection with:
9.1.1. The delivery of any of the articles set out in clauses 4.11.
9.1.2. The user’s failure to specify any special precautions to be taken in respect of a Shipment, as required under clauses 6.6, on the address label, consignment note, waybill and/or invoice.
9.1.3. The direct transfer of payment to Partner for Purchasing value of items ordered through Purchasing Service & additional charges not stated in iDelivos price list.
9.1.4. Delivery of fragile items including but not limited to items such as cupcakes, flowers, glassware and musical instruments.
9.1.5. The misalignment, wear and tear, de-arrangement, heat, mold, rot, discoloration, degeneration, explosion, ignition or the hazardous, perishable, corruptible, fragile, or brittle nature of the contents of the shipment.
9.1.6. Delay or confiscation by any government authority due to the discovery of prohibited contents of the shipment.
9.1.7. iDelivos failure to perform any of its obligations hereunder as a consequence of circumstances outside its control, including without limitation any act of God such as weather conditions, flood or earthquake, work stoppages, strikes, industrial disputes, war, any act of government, accidents, traffic obstructions or congestion, mechanical breakdown, or other events of force majeure; or
9.1.8. any acts or omissions of any party other than iDelivos, including and without limitation the User, the named addressee, any government official or any subcontractor engaged by customer.
9.1.9. Damages to items of brittle nature or damages to items due to inappropriate packaging.
9.2. iDelivos will make every reasonable effort to execute the delivery request according to iDelivos’s delivery schedules prevailing from time to time, but these schedules are not binding and do not form part of the contract. iDelivos is not liable for any damages or loss caused by delays.
9.3. iDelivos shall not be liable for delay or non-delivery of a shipment arising from or in connection with the detention of the shipment by any government authority.
9.4. iDelivos shall not be liable for indirect or consequential loss or damage, including without limitation loss of profit, income, interest, future business or anticipated savings, even if the risk of such loss or damage was brought to iDelivos’s attention before or after acceptance of the shipment.
9.5. For the avoidance of doubt, iDelivos shall not in any way be liable or responsible for a delivery item prior to the shipment being accepted by iDelivos for delivery.
- Claims
10.1. Any claims must be made within 24 hours after the delivery has been completed, failing which iDelivos shall have no liability whatsoever.
10.2. All claims must be made in writing, accompanied by the delivery order number, contact information and other supporting documents requested by iDelivos and submitted through the Contact Us Form.
10.3. Claims are limited to one claim per delivery order, settlement of which shall be full and final settlement for all loss or damage in connection therewith.
10.4. If iDelivos is satisfied that the user’s claim is justified, iDelivos’s liability for any loss of or damage to the delivery item shall be limited to the value of the delivery item or cost of the delivery order, whichever is lower. iDelivos reserves the right to determine the mode of transferring the compensation to User by;
(i) refund to the credit or debit card that was used when User made the booking, or
(ii) bank transfer
(iii) PayNow
10.5. In the case of damage to the delivery item, the amount of compensation by iDelivos shall be based on iDelivos’s assessment of the extent of the damage to and the actual cash value of the contents of the delivery item provided always that the amount of compensation shall not exceed the compensation limits. In the case of loss of or damage to the delivery item, iDelivos shall have the option of either replacing the delivery item or providing compensation within the compensation limits.
10.6. Without prejudice to clause 6.8 and based on iDelivos’s discretion, claims for perishable commodities such as food will be capped at the delivery cost or food value, whichever is lower.
10.7. In the case of damage, cake and pastry orders placed using a Motorbike are not eligible for claims. Only car and larger vehicle orders will be processed for compensation if there are damages during delivery.
10.7.1. Cake and pastry packaged in a covered box will require Partner verification and photo taking on pickup to ensure the pre-delivery integrity of items. This is a standard operating procedure that Partners are required to perform. Users may choose to refuse the Partners’ request for verification. However, this refusal will render the orders ineligible for compensation in the case of damage.
- Disclaimer
11.1. The Application is delivered to you on an “as is” basis and although iDelivos has used its best effort to ensure that the Application will work properly on your mobile device, iDelivos does not warrant the performance of the Application nor the compatibility of the Application with your mobile device.
11.2. iDelivos is a logistics platform service and the services provided are part of the on-demand sharing economy. iDelivos makes no guarantee of the availability of the services, the availability of vehicles through the use of the services, the accuracy of the data or information provided as part of the services or the quality of the services of the Partners.
11.3. iDelivos shall not be liable for any damages, claims or costs whatsoever including any consequential, indirect, incidental damages or any loss of profit or damages to your mobile device as a result of your use of the Services or your installation and / or execution of the software even if iDelivos or its representative has been advised of the possibility of such loss, damage or claim.
11.4. iDelivos shall not be liable for any loss or damages, including any injury which you may suffer as a result of your delivery, transportation or journey in the vehicle of a Partner hired through the services and all your rights in relation thereto and in relation to the contract for hire between you and the relevant Partner shall be a matter between you and the relevant Partner.
11.5. iDelivos is not the agent of Partners or users and is not a party to the contract for the hiring of the Partners.
11.6. The foregoing limitations and exclusions apply to the extent permitted by law.
- Personal Data Privacy
12.1. You may be required to submit personal information to iDelivos in order to use certain function of the software.
12.2. You agree that iDelivos can use your personal data (namely your name and contact number) as provided by you to iDelivos from time to time when you use the software for the purpose of providing the services.
12.3. You agree that iDelivos is entitled to collect, use, keep and update your personal data to such extent, for and at such time period as may be necessary when iDelivos provides the services to you, and you confirm that the personal data so provided by you are true and correct and up to date.
12.4. You further expressly consent that iDelivos is entitled to transfer your personal data to the Partners as may be necessary including, without limitation for the purposes of sourcing a booking to be accepted by a Partner, confirmation/clarification of the booking information between you and the Partner, and tracking the booked vehicles when iDelivos provides the services to you.
12.5. You further agree that the collection, use, storage and transfer of your personal data is generally subject to iDelivos’s privacy policy and personal information collection statement the latest version(s) thereof is at “www.iDelivos.com”, and you acknowledge that you have read and understood the same prior to agreeing to these terms and conditions.
12.6. You agree that personal information such as your name, contact number and email address can be used for all promotional and marketing efforts of iDelivos.
12.7. If you no longer wish to receive e-marketing materials from iDelivos, you may unsubscribe from our mailing list by clicking on the Unsubscribe button or inform iDelivos using the Contact Us Form at https://idelivos.com/contact-us/, and no further information will be sent to your email address.
- Governing Law
13.1 These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Singapore.
- No Waiver
14.1 The failure of iDelivos to enforce any right or Provision of the Terms of Use shall not constitute a waiver of such right or provision.
- Rules of Usage
15.1. You shall not use the software for or to promote any illegal acts.
15.2. You shall not use the software to produce any email advertisements or spam emails.
15.3. You shall not use the software in any way to track, stalk, harass or hurt any person.
15.4. You shall not in any way interrupt/destroy the operation of the software or the servers/network that linked with the software; Nor violate the network requirements, process, or Terms of Use that were mentioned when using the software.
- Promotions
16.1. iDelivos will run promotions from time to time. All promotions provided are subject to the prevailing regulatory requirements. iDelivos reserves the right to revise, suspend or terminate these requirements or Terms of Use at any time and iDelivos may withdraw the offer at its discretion without prior notice.
